Electric Bike Rental Terms & Conditions

§1. General Provisions

  1. These Terms and Conditions define the rules for the rental of electric bicycles by GR8 WAY Sp. z o.o., ul. Św. Jana 2, 31-018 Kraków, NIP 6762551411, hereinafter referred to as the Lessor.
  2. These Terms and Conditions apply to all clients using the electric bicycle rental service, hereinafter referred to as the Lessee.
  3. Rental services are provided at the Lessor’s stationary location in Kraków or based on an online reservation.
  4. Signing the rental agreement or collecting the bicycle constitutes acceptance of these Terms and Conditions.

§2. Rental Conditions

1. Requirements for the Lessee

The Lessee may be any person who:

  • is at least 18 years old,
  • holds a valid identity document,
  • possesses a payment card or sufficient funds for the deposit.
  1. Persons under 18 years of age may use a bicycle only with the written consent of their legal guardian.
  2. The Lessor reserves the right to refuse rental without giving a reason.

§3. Reservation and Payments

  1. Reservations can be made online, by phone, or directly at the rental point.
  2. Payment for the rental must be made in advance according to the current price list.
  3. The price list constitutes an integral part of these Terms and Conditions and is available at the rental point and on the website.
  4. The rental period is calculated from the moment the bicycle is issued until the moment it is returned.

§4. Deposit

  1. The Lessor collects a refundable deposit in the form of a card pre-authorization or a cash payment.
  2. The deposit is refunded after the timely return of the bicycle in undamaged condition.
  3. The Lessor may reduce or waive the deposit if the Lessee purchases additional insurance.

§5. Obligations of the Lessee

1. The Lessee is obliged to:

  • use the bicycle in accordance with its intended purpose,
  • comply with road traffic regulations,
  • secure the bicycle against theft,
  • not make the bicycle available to third parties.

2. It is prohibited to:

  • ride under the influence of alcohol or intoxicants,
  • participate in competitions or extreme rides,
  • interfere with the construction of the bicycle or its battery.

§6. Liability

1. Financial Responsibility

The Lessee bears full financial responsibility for:

  • any damage to the bicycle,
  • theft or loss,
  • damage caused to third parties.
  1. In the event of theft, the Lessee is obliged to immediately report the incident to the Police and the Lessor.
  2. The cost of repairs or the loss of the bicycle may be deducted from the deposit.

§7. Return of the Bicycle

  1. The bicycle must be returned by the date and time specified in the agreement.
  2. A delay in returning the bicycle will result in an additional charge according to the price list.
  3. Returning a dirty bicycle or one requiring above-standard cleaning may result in an extra fee.

§8. Insurance

  1. The Lessor offers optional extended insurance.
  2. Insurance does not cover damage caused by gross negligence or riding under the influence of alcohol.

§9. Complaints

  1. Complaints should be submitted immediately after the end of the rental period.
  2. Complaints are reviewed within 14 days.

§10. Personal Data

  1. The controller of personal data is GR8 WAY Sp. z o.o.
  2. Personal data are processed solely for the purpose of performing the rental agreement in accordance with the GDPR.

§11. Final Provisions

  1. These Terms and Conditions come into force on the date of publication.
  2. The Lessor reserves the right to amend the Terms and Conditions at any time.
  3. In matters not covered herein, the provisions of the Civil Code shall apply.
